1. GENERAL PRESENTATION
The website www.dietworld.eu is an "e-commerce" merchant site accessible via the Internet, published by Diet World, a public limited company with a capital of €125,335.50, whose registered office is located at 12/14 Rond point des Champs-Elysées 75008 Paris, France, registered with the Paris Trade and Companies Register under number 450 248 463.
These general terms and conditions of sale (GTCS), dated January 2, 2020, define the rights and obligations of Diet World and the consumer Client in the context of the sale of Products by DietWorld on this Site.
It is specified that the Site is intended for consumers purchasing Products. Products purchased on this Site are not intended for resale by Clients, unless otherwise specifically, prior and written agreed by DietWorld.
The delivery area covered by DietWorld is strictly limited to France, including Corsica and overseas departments and territories, and European countries.
Any Order of a Product offered on the Site implies the unreserved acceptance of these GTCS by the Client, including the "Legal Notice" and "Cookies Policy" tabs also accessible on the Site.
2. DEFINITIONS
The Parties agree and accept that the following terms, used with a capital letter in these GTCS, shall have the meaning given to them below:
"GTCS" refers to these General Terms and Conditions of Sale accessible on the Site and applicable to any purchase of a Product on the Site.
"Client" refers to any adult individual purchasing one or more Products on the Site for private and non-professional use (purchase for resale prohibited).
"Order" refers to the acquisition by a Client of a Product on the Site under the conditions provided by these GTCS.
"Product" refers to a Lot which may include the following items:
- hygiene products of the DietWorld brand
- cosmetic products of the DietWorld brand
The composition of each box or assortment is detailed on the Site.
"Site" refers to the website www.dietworld.eu
3. PRODUCT CHARACTERISTICS
DietWorld's offer "www.dietworld.eu" is reserved for the Client.
It is the client's responsibility to comply with the consumption methods of the items making up the delivered Product, according to the instructions and recommendations appearing on the item packaging.
It is the client's responsibility to inquire about intolerances or allergies before placing any order, and to check product packaging and the list of ingredients. This information is provided by DietWorld at the time of ordering the Products.
The client must comply with the storage conditions mentioned on the product packaging.
DietWorld strives to guarantee the best service and the availability of its Products.
4. APPLICABLE PRICE
Product prices can be viewed on the Site.
On the site pages, product prices are indicated in euros, all taxes included (TTC), taking into account the VAT applicable on the day of the Order. Delivery costs are billed additionally to the client and are indicated in the order summary under the heading "delivery costs". They may be offered as part of specific promotional offers.
The applicable prices are those in effect on the day of the order. They may be modified at any time by DietWorld. In such a case, the new prices of the Products will be updated on the Site by DietWorld.
5. ORDER AND PAYMENT
5.1 Order Procedures
When placing the first order, the client must create a personal account by completing the registration form and choosing a password, ensuring it is secure and not disclosed to protect their personal data.
To order, the client must, after identifying themselves or creating their personal account, fill out the order form by entering the following mandatory information: the nature and quantity of Products ordered, their name, their choice of delivery method, the delivery address (necessarily within the eligible territories), the billing address, their payment methods, an email and a phone number.
Once all the requested information has been completed by the client, the latter can only proceed to the next step by confirming that they have read and accepted the GTCS by checking the box "I have read and accepted the General Terms and Conditions of Sale".
If mandatory fields are missing, a screen will appear asking the Client to modify/complete the said fields.
An order summary then appears on the screen; this page displays the Client's billing address, the delivery address of the products, a summary table of the order (nature, quantity and price of the Products), delivery costs, and the total amount of the order. After checking this information and, if necessary, modifying it, the Client is invited to confirm the accuracy of the summary table by confirming their shopping cart. They must then definitively validate their order by clicking on the "Pay with..." button.
The validation of the order constitutes an electronic signature. This signature has the same value between the Parties as a handwritten signature and serves as proof of the entirety of the order, acceptance of the order, and the enforceability of the sums due in execution of the said order. As soon as the order is validated, the client becomes a buyer.
DietWorld reserves the right not to validate the order in case of an abnormal order, existing dispute(s) with the client, total or partial non-payment of a previous order by the client, a refusal of payment authorization by credit card from banking institutions, or a case of Force Majeure as defined by law and jurisprudence.
5.2 Payment
The price due by the client (price of the Products including tax and delivery costs) is the amount indicated on the order summary, which the client reviewed before validating their order. The price is then reiterated after payment in the summary document sent by email to the email address provided by the client.
Payment can be made by credit card (Carte Bleue, Visa or Mastercard) in accordance with the terms below.
To pay for their Order online, the client selects the credit card payment method. They are then redirected to a secure site managed by our financial partner.
All transactions made on the Site are secured. Banking information relating to the client is encrypted by the SSL (Secure Socket Layer) system then processed by DietWorld's financial partner. The client's data does not pass through the Site and only DietWorld's partner bank has access to this information.
For credit card payment, the client must transmit their credit card number on a secure site and, depending on the type of card, its expiration date and the cryptogram number (3-digit number on the back of their credit card).
The card is debited at the time of final validation of the order.
It is the client's responsibility to save and print their payment certificate if they wish to keep their banking details and transaction information.
5.2.1 Installment payment with Alma
Alma's credit service is offered for the settlement of purchases and the execution of payment, provided that the person purchasing the good or service through Alma ("Buyer") accepts the installment payment or deferred payment agreement.
Fees may be charged by Alma.
Any refusal by Alma to grant installment payment or deferred payment may lead to the invalidity of the purchase agreement for the good or service ("GTCS"), unless the Buyer agrees to pay the purchase amount in full.
In the event of termination of the GTCS, the installment payment or deferred payment agreement will be automatically terminated.
In the event of withdrawal from the installment payment or deferred payment solution used for your payment, the GTCS will be automatically terminated, unless you pay the amount of your purchase in full through Alma. If the product has already been shipped to you, you must return it within the maximum period provided in these GTCS.

Alma accepts bank cards issued by banks from the following countries:
France, Belgium, Spain, Germany, Italy, Austria, Ireland, Luxembourg and
Netherlands.
However, certain types of cards do not allow installment or deferred payment with Alma. These include:
Cards issued by foreign banks;
Prepaid cards, such as Correos, MoneyToPay, Spark, etc.
Indeed, most of these cards do not have sufficiently secure authentication procedures to allow installment or deferred payment with Alma.
5.3 Order Acknowledgement
Upon payment, an order summary document is sent to the client by email to the email address provided by the latter in the order form.
This document serves as an acknowledgment of receipt of the order and summarizes all essential elements constituting the client's order.
5.4 Modification/Deletion of Client Information
The client can at any time modify/delete their personal information in the "my account" section accessible from the Site.
The client guarantees at each Order to check if the personal information communicated in the Order form is still correct.
DietWorld cannot be held responsible in the event that the Client provides incorrect information that prevents the validation of the Order or the delivery of the Products.
5.5 Invoicing
The invoice is issued on the date of shipment of the order. A delivery note is attached to the client's package. The invoice is available for download on the Client's account at www.dietworld.eu
6. DELIVERY
6.1 Delivery Location
The customer will be delivered according to their choice:
A. To the address they have expressly designated in France (including Corsica and overseas departments and territories) or a European country and other countries, and for which they must have provided, when placing their Order, all necessary and accurate information and contact details to allow for the delivery of the Product (such as, in particular: street number, building number, staircase number, access codes, intercom names and/or numbers, etc.)
B. To a relay point (option not available)
DietWorld cannot be held responsible in case of delay or absence of delivery if this delay or absence of delivery is due to the Client providing inaccurate or incomplete information.
6.2 Delivery Date
The delivery time will be indicated in the order summary. It will be within a period of two (2) days to thirty (30) days from the validation of the order.
If applicable, in the case of home delivery, if the Client is absent, they may contact the carrier using the contact details indicated by the latter on the delivery notice to set a new delivery slot.
In the case of delivery to a relay point, the Client will have fourteen (14) working days to collect their order. Failing this, the order will be returned and a flat fee of eight (8) euros will be requested from the client if they wish to be redelivered.
6.3 Receipt of products – Reservations and claims
The customer will check the conformity of the delivered Products to identify any anomalies concerning the delivery such as missing or damaged products, missing or damaged packaging/overpackaging.
It is specified that if the substitution of an item (see 6.4) has been accepted by the customer, the replaced product cannot be considered as missing.
Any reservation must be promptly notified to DietWorld Customer Service by email via our contact form within two (2) days following receipt of the Product(s).
Without prejudice to the rights the customer has under statutory guarantees (see Article 8), any claim made beyond this notification period following the delivery of the Product(s) will be considered inadmissible.
DietWorld reserves the right to ask the customer to keep the non-conforming or damaged product(s) at their disposal for fifteen (15) days from their claim.
In case of abusive claims, DietWorld may refuse to fulfill a subsequent Order placed by the customer concerned.
6.4 Unavailability of an item or Product
In case of unavailability of one or more items composing the product, DietWorld will offer the client to substitute it with an item already present in the chosen Product offer. In such a hypothesis, the client will be contacted by DietWorld to validate the substitution proposal, it being understood that the Order may be canceled if the client wishes.
If the order is cancelled by the client, the latter will be reimbursed by www.bslim-france.com, by bank transfer to the credit card used for payment, within a maximum of fourteen (14) days following the cancellation.
6.5 Non-collection of package by the Client
In the event that the client does not collect their package from the carrier or relay point within the allotted time, the package is returned to DietWorld. DietWorld will offer to reship the order by applying a flat fee of eight (8) euros if the client wishes to be redelivered. Otherwise, their order will be refunded. DietWorld will refund the client, excluding delivery costs, by bank transfer to the credit card used for payment, within a maximum of fourteen (14) days following the client's notification of their wish to return the product(s); the refund may be deferred until receipt of the returned products.

7. RIGHT OF WITHDRAWAL
In accordance with Article L. 221-18 of the Consumer Code, the client has a period of fourteen (14) clear days from delivery to notify DietWorld of their wish to exercise their right of withdrawal. To exercise this right, the client must complete the withdrawal form (made available on the Site and also communicated to them by email upon order confirmation) and send it to Customer Service by email via our contact form.
The client has a period of fourteen (14) clear days, from the notification of their decision to withdraw, to return, at their own expense and without having to justify any reason, the product(s) they ordered. The products must imperatively be returned in their original and intact packaging.
The return of the product(s) will be at the Client's expense. The products must be returned to DietWorld Customer Service at 32 impasse Bajou, 94230 Cachan, France in their original packaging and condition and be accompanied by the duly completed Withdrawal Form available on the Site.
If the aforementioned conditions are met, DietWorld will reimburse the client, excluding delivery costs, by bank transfer to the credit card used for payment, within a maximum of fourteen (14) days following the client's notification of their wish to return the Product(s); the reimbursement may be deferred until receipt of the returned Products. If the refund concerns an installment payment or deferred payment with Payplug, the refund period depends on Payplug and is 90 days.
8. PRODUCT CONFORMITY AND LEGAL GUARANTEES
DietWorld takes care to represent and describe the characteristics of the products on the Site as accurately as possible. However, its liability cannot be engaged in case of a non-substantial difference between the reproduction of the Products on the Site and the delivered Products. The Client must first refer to the product packaging.
DietWorld is liable for any defects in conformity of the Product with the contract under the conditions of articles L.217-4 et seq. of the Consumer Code and for hidden defects of the sold item under the conditions provided for in articles 1641 et seq. of the Civil Code.
The guarantor of the product's conformity and defects of the sold item is DietWorld. When acting under the legal guarantee of conformity, the Customer benefits from a period of two years from the delivery of the Product to act;
may choose between repair or replacement of the Product, subject to the cost conditions provided for in article L.217-9 of the Consumer Code;
The customer may decide to implement the guarantee against hidden defects of the sold item within the meaning of article 1641 of the Civil Code and in this case, he may choose between rescinding the sale or a reduction in the sale price in accordance with article 1644 of the Civil Code.
Complaints relating to product quality can be made by telephone at 01 46 66 28 05 (non-surcharged number). The procedures to be followed by the Customer will be specified by DietWorld's Customer Service.
9. LIABILITY
DietWorld disclaims all liability in the event that the non-performance or delay in the performance of one or more obligations contained in the GTC results from a case of force majeure as defined below.
Similarly, DietWorld cannot be held liable for any inconveniences or damages inherent in the use of the Internet, including service interruption, external intrusion, or the presence of computer viruses. DietWorld reserves the right to modify or temporarily interrupt all or part of the Site's services for technical reasons or for compliance purposes, without prior notice to the customer.
Finally, DietWorld cannot be held responsible in case of poor storage conditions of the Products after delivery, in case of consumption after the Best Before Date, or in any other case where the Customer has not complied with the hygiene rules brought to their attention by www.bslim-france.com or by health authorities.
It is expressly agreed that articles 1221, 1222, and 1223 of the Civil Code can only be invoked against DietWorld after a judicial decision.
10. INTELLECTUAL PROPERTY
All Intellectual Property rights relating to the Site as well as to the documents sent with the Products, whether visual or audio, including the underlying technology, belong exclusively to DietWorld.
As such, and in accordance with the provisions of the Intellectual Property Code, only use for private purposes is authorized, subject to different provisions of the intellectual property code. Any total or partial reproduction of the Site is strictly prohibited.
The act of affixing any simple link or a hypertext link to the Site, by notably using the technique known as "framing" or "deep linking," is strictly prohibited.
11. MODIFICATION OF THE GTC
DietWorld reserves the right to unilaterally modify the GTC at any time and without prior notice by publishing a new version on the Site, which will apply to any order placed after its initial online publication.
By checking the box on the Site button "I have read and accepted the general terms and conditions of sale" at the end of the Order process, the customer acknowledges having read and unreservedly accepted all of the GTC.
The applicable GTC are those in force on the day of delivery of the order.
12. PERSONAL DATA
In application of the "Informatique et Libertés" law of January 6, 1978, as amended, every Customer benefits from a right to access, oppose, and rectify personal information they provide in the context of any order.
This right of access, rectification, and opposition specifically concerns the Customer's names, addresses (home and email), and bank details. The Customer can exercise this right of access, rectification, and opposition by sending an email via our contact form.
By ordering a product on the Site, the customer accepts that DietWorld (or its service providers it uses in this context) uses the personal information they have provided to ensure the realization, management, tracking, and delivery of the Order.
13. APPLICABLE LAW AND JURISDICTION
These GTC are governed by and interpreted in accordance with French law.
14. FORCE MAJEURE
In accordance with Article 1218 of the Civil Code, DietWorld shall be released from its obligations for any unforeseeable and irresistible event that prevents or delays, in particular, the manufacture and delivery of its products, constituting a case of force majeure. This will be the case, in particular, for events occurring at DietWorld such as: strike, fire, epidemic, embargo, especially of tools, machine breakage, interruption or delay of transport, inability to be supplied, raw material shortages, or any other event beyond its control, as well as for any event recognized as a case of force majeure by French jurisprudence.
15. CONSUMER MEDIATION
In the event of a dispute between the parties and following the failure of a written complaint by the customer to DietWorld's customer service or in the absence of a response from this service within a reasonable period of one (1) month, the customer, within one year of their complaint, may resort to any alternative dispute resolution method, including mediation, by contacting the following mediator(s):

and/or by accessing the European online dispute resolution platform at the following address: http://ec.europa.eu/odr .
This procedure is free of charge, and the Customer may, at their own expense, be assisted by counsel. The customer is free to accept or refuse recourse to mediation and, if applicable, the solution proposed by the mediator.
16. NON-WAIVER
The fact that DietWorld does not invoke any of the clauses of these GTC shall not constitute a waiver of their future application.
17. MISCELLANEOUS
These online GTC prevail over printed general terms and conditions of sale.

18. Loyalty and referral program
DietWorld offers a loyalty program allowing customers to accumulate points and receive discounts.
1. Earning points
Customers earn points according to the following terms:
- 10 points per euro spent
- 100 points offered upon registration
- Additional points granted when subscribing to the brand's Facebook and Instagram pages
Points are automatically credited to the customer account after validation of actions.
2. Using points
Points can be exchanged according to the following conversion:

Discounts:
- are applicable across the entire site
- are not exchangeable for cash
- are only usable during an order
3. General conditions
- Points are strictly personal
- They cannot be assigned or transferred
- In case of fraud or abuse, DietWorld reserves the right to delete points
4. Referral Program
The customer can refer a third party via the system provided for this purpose.
- The referred person receives a €10 discount valid for any order with a minimum amount of €50
- The referrer receives a €10 reward, activated after validation of the referred person's first order, and usable for any order with a minimum amount of €50
5. Program modification
DietWorld reserves the right to modify or suspend the loyalty and referral program at any time.
